These GENERAL TERMS and CONDITIONS govern the relationship between “Katerina 7” OOD, from now on referred to as “Merchant” or “Reviewly.bg” on the one hand, and the Users of websites and services located at the domain https://cleopatrabg.com (referred to as from now on “Users”), on the other hand.

“Katerina 7” Ltd. is a company registered under the Commercial Law of the Republic of Bulgaria with EIK 204981218, with headquarters and management address: Sofia 1700, Studentski Grad, bl. 58, entrance A, email address: [email protected], phone +359 893 97 31 27.

Please read the published General Terms and Conditions in full before using the information and commercial services offered by the site https://reviewly.bg (called Services for short). By viewing https://reviewly.bg, each User automatically complies with the conditions described below.

This document contains information about the activities of “Katerina 7” Ltd. and the general conditions for using the services provided by “Katerina 7” Ltd., which govern the relationship between us and each of our users.

Confirmation of the General Terms and Conditions is a necessary and mandatory condition for concluding the contract between the User and “Katerina 7” OOD.

SERVICES PROVIDED

Art. 1. “Reviewly.bg” is an electronic store on https://Reviewly.bg.com. Users can conclude contracts for purchasing, selling, and delivering the goods offered by “Reviewly.bg”.

IDENTIFICATION AND REGISTRATION. PERSONAL DATA

Art. 2 (1) “Reviewly.bg” identifies the site users by storing log files on the https://Reviewly.bg.com server and the User’s IP address.

(2) “Reviewly.bg” can collect and use user information during identification and registration. The information by which the person can be identified may include name, surname, date of birth, gender, address, telephone, and any other information the person voluntarily provides during registration. The information includes any other information the User enters, uses, or provides when using the Services provided by “Reviewly.bg”.

Art. 3 (1) “Reviewly.bg” takes due care and is responsible for protecting the information about the User, which became known to him on the occasion of registration – subject to these General Terms and Conditions, except in cases of force majeure, accidental event or malicious actions of third parties.

(2) In the registration form filled out by the User during registration, “Reviewly.bg” indicates the mandatory or voluntary nature of providing the data and the consequences of refusing to provide them. By agreeing with these General Terms and Conditions, the User agrees to have their information processed in the order provided.

(3) The restrictions under para. 1 does not apply if “Reviewly.bg” is obliged to provide personal information about the User to the relevant competent state authorities according to the current legislation.

Art. 4 (1) “Reviewly.bg” collects and uses the information under Art. 4 for the purposes provided for in these General Terms and Conditions, as well as for offering new goods and services to the User (free or paid). The described purposes for which the information is used are not exhaustively listed and do not create obligations for “Reviewly.bg”.

(2) By accepting these General Terms and Conditions, the User agrees to the processing of his personal data for this contract and direct marketing purposes.

Art. 5 (1) The User can register by filling in the relevant electronic registration form, available in real-time (online) on the Internet on the “Reviewly.bg” website, and express agreement with these General Terms and Conditions.

(2) By pressing the virtual button “Registration,” having the force of written confirmation of the General Terms and Conditions, the User makes an electronic statement within the meaning of the Electronic Document and Electronic Signature Act, by which he declares that he is familiar with these General Terms and Conditions, accepts them and undertakes to comply with them. By recording it on a suitable medium in the server of “Reviewly.bg” through a generally accepted standard for conversion in a technical way, making possible its reproduction, the electronic statement acquires the quality of an electronic document in the sense of the cited law. “Reviewly.bg” can store in log files on its server the IP address of the User, as well as any other information necessary for his identification and reproduction of his electronic statement of acceptance of the General Terms and Conditions in the event of a legal dispute. The text of these General Terms and Conditions is available on the “Reviewly.bg” website in a way that allows its storage and reproduction.

(3) When completing the registration application, the User is obliged to provide complete and correct data regarding identity (for individuals), legal status (for legal entities), and other data required by the electronic form of “Reviewly.bg”, as well as to updates them within 7 (seven) days of their change. The User declares that he agrees to provide the requested personal data, guaranteeing that the data he provides during the registration process is true, complete, and accurate. If the latter changes, he will update them on time. In the case of providing incorrect data, “Reviewly.bg” has the right to terminate or stop immediately without notice of the provision of services and the maintenance of the User’s registration.

Art. 6 (1) Upon registration, the User receives a unique username and password to access the services available through the “Reviewly.bg” website. The username can also be the User’s email.

(2) The username with which the User registers does not give him any other rights except the right to use the specific username within the “Reviewly.bg” e-shop.

(3) in his capacity as a legal entity representative, the registrant is obliged to enter his full name and address, resp—the name of the legal entity it represents. By accepting the General Terms and Conditions, he guarantees and confirms that he has a contractual relationship with the user company registered by him. By entering incorrect or misleading information, the party is deprived of the right to access the “Reviewly.bg” website services.

(4) The User is obliged to take all care and take the necessary measures that are reasonably necessary to protect his password, as well as not to disclose his password to third parties and to immediately notify “Reviewly.bg” in case of unauthorized access, as well as in the case of probability and suspicion of such. He bears the responsibility and risk for the protection of his password and for all actions carried out by him or a third party using his password.

Art. 7 (1) The User has the right to access in online mode the services provided through the “Reviewly.bg” website, subject to the conditions and requirements for access defined by “Reviewly.bg”. To use the services, the User must enter his username and password.

(2) The User has the right to access and correct his data provided during registration online.

ORDERS

Art. 8 (1) Users use the interface of the “Reviewly.bg” website to enter into contracts for the purchase and sale of the goods offered by “Reviewly.bg” in the electronic store.

(2) The contract for the purchase and sale of goods is concluded from the moment of confirmation of the order by “Reviewly.bg”.

(3) In case of lack of availability of a given product, “Reviewly.bg” reserves the right to refuse the order.

Art. 9 (1) After selecting one or more goods offered on the “Reviewly.bg” website, the User must add the same to his list of goods for purchase.

(2) It is necessary for the User to provide data for carrying out the delivery and to choose a method and time of payment of the price, after which to confirm the order through the interface of the electronic store.

PRICES

Art. 10 (1) The prices of the products offered in the online store are those indicated on the “Reviewly.bg” website when placing an order, except in cases of obvious error.

(2) The prices of the products include VAT in the cases in which its charging is provided.

(3) The prices indicated on the site do not include packaging and transportation. Suppose the goods are sent outside the territory of the Republic of Bulgaria. In that case, the User must pay all customs, etc. export related charges.

Art. 11 “Reviewly.bg” reserves the right to change the prices of the products offered in the online store at any time and without notice; such changes will not affect orders already made.

Art. 12 (1) “Reviewly.bg” can provide discounts for the products offered in the online store, according to the Bulgarian legislation and rules determined by “Reviewly.bg”. The rules applicable to such discounts are available where the discount is displayed. Discounts may be provided in various forms (e.g., promotions, loyalty discounts provided individually, randomly, or as a result of participation in a competition or customer survey).

(2) Different discounts cannot be combined when ordering and purchasing the same product.

PAYMENT

Art. 13 When the User returns a product with the right to a refund of the amount paid for any reason, the price subject to the refund is reduced by the value of the discount received applied to the product. Only the amount paid is subject to a refund.

Art. 14 (1) The User can pay the price of the ordered goods using one of the options listed on the website. At https://Reviewly.bg.com, paying by cash on delivery, postal money transfers (PMT), and by credit or debit card through the STRIPE system is possible.

(2) If the User chooses the option of courier delivery and cash on delivery payment, he must pay the price of the ordered items and the courier delivery price upon receipt of the goods.

Art. 15 If the User chooses a payment method involving a third-party payment service provider, the User may be bound by the terms and conditions and fees of such third party.

Art. 16 “Reviewly.bg” is not responsible if a payment method involving a third-party payment service provider is unavailable or otherwise does not function for reasons beyond the fault of “Reviewly.bg”. “

DELIVERY

Art. 17 (1) Courier delivers the ordered goods to the office, vending machine, or delivery address specified by the User in the territory of the Republic of Bulgaria. Delivery is at the User’s expense unless otherwise expressly indicated on https://Reviewly.bg.com.

(2) Before sending the ordered goods, “Reviewly.bg” has the right to contact the User on the phone, as indicated by him, to specify details about the order and/or delivery.

(3) “Reviewly.bg” is not responsible for failure to fulfill an order in cases where the User has specified false, incomplete, and/or inaccurate personal data, including when he has specified an incomplete, inaccurate, or fictitious address or telephone number.

(4) “Reviewly.bg” guarantees its Users that the goods ordered will be additionally packed in discreet packaging. The name “Reviewly.bg” will not appear anywhere in the shipment, and the goods can be described as equipment, cosmetics, accessories, or others.

Art. 18 Delivery is made within the timescales described under each delivery option in the ordering interface module. In exceptional circumstances, “Reviewly.bg” reserves the right to extend the delivery period, promptly informing the User.

Art. 19 The ordered goods can be delivered to the User’s address and an office or courier machine. The ordered goods are accepted against a signature. In the case of larger shipments (at the courier’s discretion), they are delivered to the User’s address.

Art. 20 The User is obliged to inspect the goods at the time of their delivery and to notify us immediately in case of any discrepancies, shortages, or damages. If the User does not do this, it is assumed that the delivery has been accepted without objection.

Art. 21 (1) When making international deliveries, the rules for delivery and receipt of shipments of the relevant national post office and the relevant national legislation of the country where the recipient of the goods is located are applicable.

(2) All import fees are for the User’s account when importing the goods. The consumer cannot request a refund if he has refused to pay the import charges or receive the shipment.

Art. 22 “Reviewly.bg” reserves the right to change the available delivery and payment methods and/or the conditions thereof by publishing the available delivery and payment methods on the website without further notice.

WAIVER AND SUBSTITUTION

Art. 23 (1) The User has the right to withdraw from the contract without stating a reason, without owing compensation or penalty, within 14 days from the date of acceptance of the goods by the User or by a third party.

(2) To exercise his right under this clause, the User must unequivocally notify “Reviewly.bg” of his decision to withdraw from the contract, individualizing the goods he wishes to return, by providing all the details of the completed order and delivery, including but not limited to content and value of the order, details of the person who placed the order, details of the person who accepted the delivery and date of delivery.

(3) “Reviewly.bg” publishes a form for exercising the right to withdraw from the contract on its website.

(4) To exercise the right of refusal, “Reviewly.bg” provides the User with the option of filling out and sending the standard refusal form or another unambiguous application electronically through the website. In these cases, “Reviewly.bg” immediately sends the User a confirmation of receipt of his refusal.

(5) The User is obliged to return the goods at his own expense along with the receipt and the invoice, if any, by handing them over to “Reviewly.bg” or to a person authorized by the latter within 14 days from the date on which The User has exercised his right to withdraw from the contract.

(6) When returning the goods, they must be in their original packaging, without signs of use or damage to the commercial appearance.

(7) “Reviewly.bg” has the right to postpone the refund of payments until the goods are received back or until proof is presented that the goods have been sent back, depending on which of the two events occurred earlier.

(8) In case the User does not fulfill his obligation under paragraph 5, without notifying “Reviewly.bg” about the delay and without providing a valid reason for the same, it is considered that he has withdrawn his statement to exercise the contract waiver.

(9) When “Reviewly.bg” has incurred expenses in connection with the execution of the contract and the User withdraws from the contract, “Reviewly.bg” has the right to retain the corresponding amount for the incurred expenses or to demand their payment.

Art. 24 (1) The User has no right to withdraw from the contract if the subject of the contract is:

for the delivery of goods made to the order of the User or according to his requirements;
for the delivery of goods which, due to their nature, may deteriorate in quality or have a short shelf life;
For the delivery of sealed goods which have been unsealed after their delivery and cannot be returned for hygiene or health protection reasons;

Art. 25 “Reviewly.bg” reimburses the User the price he paid for the returned goods.

WARRANTIES AND COMPLAINTS

Art. 26 (1) The User has the right to claim for any non-conformity of the goods with what was agreed/ordered when, after delivery, non-conformities with the sales contract are discovered.

Art. 27 Any non-conformity of the consumer goods with the contract of sale which appears up to 1 month after the delivery of the goods is deemed to have existed at the time of delivery, unless it is proved that the lack of conformity is due to the nature of the goods or the character of the discrepancy.

Art. 28 The Consumer cannot dispute the conformity of the consumer goods with the contract for its sale when at the time of concluding the contract, he knew or could not have known about the discrepancy;

Art. 29 (1) The Consumer has the right to complain about the goods, regardless of whether the manufacturer or the trader has provided a commercial guarantee for the goods or service.

(2) When the claim is satisfied by replacing the goods with another one corresponding to the agreed, “Reviewly.bg” will keep the original warranty conditions for the User.

Art. 30 (1) When presenting a complaint about a product, the Consumer can claim a refund of the amount paid to replace the product with another one corresponding to the agreed or a deduction from the price.

(2) The complaint is submitted verbally to the telephone number specified by “Reviewly.bg” or in writing via the specified email, by post, or submitted to the company’s address. “Reviewly.bg” provides access to a complaint form on its website.

(3). When submitting a complaint, the User indicates the subject, his preferred way of satisfying the complaint, the amount of the claimed amount, and the address, phone number, and email address for contact.

(4) When submitting a complaint, the User must also attach the documents on which the claim is based, namely:

receipt and/or invoice;
protocols, acts, or other documents establishing the non-compliance of the goods or services with the agreed;
Other documents establish the claim by basis and amount.

Art. 31 (1) “Reviewly.bg” maintains a register of submitted claims.

(2) When “Reviewly.bg” satisfies the complaint, it issues a certificate to that effect, which is drawn up in two copies and obligatorily provides one copy to the User.

Art. 32 (1) “Reviewly.bg” if a justified complaint brings the goods into compliance with the sales contract within one month, counted from the submission of the complaint by the User.

(2) If the goods are not repaired even after the expiration of the period under the previous paragraph, the Consumer has the right to cancel the contract and to be reimbursed the amount paid or to request a reduction in the price of the consumer goods according to Art—114 of the Civil Code.

Art. 33 (1) In case of non-compliance of the consumer goods with the sales contract and when the Consumer is not satisfied with the resolution of the complaint, he has the right to choose between one of the following options:

• Cancellation of the contract and refund of the amount paid by him;
• Price Reduction.

(2) The Consumer cannot claim a refund of the amount paid or a reduction in the price of the goods when the trader agrees to replace the consumer goods with a new one or to repair the goods within one month of the Consumer’s complaint.

(3) The trader is obliged to satisfy a request for cancellation of the contract and to refund the amount paid by the Consumer when, after having satisfied three complaints of the Consumer by repairing the same product within the warranty period, there is a following occurrence of non-compliance of the goods with the sales contract.

(4) The Consumer cannot claim to cancel the contract if the non-conformity of the consumer goods with the contract is minor.

UNILATERAL TERMINATION

Art. 34 “Reviewly.bg” has the right at its discretion, without giving notice, to unilaterally terminate the contract in case it finds that the provided services are used in violation of the present general conditions, the legislation in the Republic of Bulgaria and generally accepted moral norms.

INTELLECTUAL PROPERTY

Art. 35 (1) The intellectual property rights on all materials and resources located on the “Reviewly.bg” website (including available databases) are subject to protection under the Copyright Act and related rights, belong to “Reviewly.bg” or to the correspondingly designated person who assigned the right to use “Reviewly.bg”, and may not be used in violation of current legislation.

(2) In the case of copying or reproduction of information beyond what is permissible, as well as in case of any other violation of intellectual property rights on the resources of “Reviewly.bg”, “Reviewly.bg” has the right to claim compensation for the direct and indirect damages suffered. (3 Except in cases where it is expressly agreed, the User may not reproduce, change, delete, publish, distribute, or publicize in any other way the information resources published on the “Reviewly.bg” website.

Art. 36 (1) “Reviewly.bg” undertakes due care to provide the User with an opportunity for normal access to the services provided.

(2) “Reviewly.bg” reserves the right to suspend access to the provided services. “Reviewly.bg” has the right, but not the obligation, at its discretion to delete information resources and materials published on its site.

TERMINATION AND CANCELLATION OF AGREEMENT

Art. 37 (1) Apart from the cases provided for in these General Terms and Conditions, the contract between the parties is also terminated upon suspension of the activity of “Reviewly.bg” or termination of maintenance of its website.

Art. 38 Apart from the cases mentioned above, each party may cancel this contract by giving a one-week notice to the other party in case of non-fulfillment of the obligations under the contract.

Art. 39 The written form of the contract is considered complied with by sending an email message, pressing an electronic button on a page with content that is filled in or selected by the User or marking a field (check box) on the website, etc. similar, insofar as the statement is technically recorded in a way that makes it possible to reproduce it.

RESCUE CLAUSE

Art. 41 The parties declare that if any of the clauses under these General Terms and Conditions is/are found invalid, this will not invalidate the entire contract or any other parts. The mandatory rules of law or established practice will supersede the invalid clause.

AMENDMENT OF TERMS AND CONDITIONS

Art. 42 (1) “Reviewly.bg” undertakes to notify the Users of any change in the present general conditions within 7 days of the occurrence of this circumstance at the email address specified by the User.

(2) When he does not agree with the amendments to the general conditions, the User has the right to withdraw from the contract without giving a reason and without owing compensation or penalty. To exercise this right, the User should notify “Reviewly.bg” within one month of receiving the message under the previous paragraph.

(3) If the User does not exercise his right to withdraw from the contract per the procedure stipulated in these general conditions, it is considered that the User has accepted the amendment without objection.

APPLICABLE LAW

Art. 43 The provisions of the current legislation of the Republic of Bulgaria apply to all matters not settled by these General Terms and Conditions.
